The warning seems to say opposite:

In toplevel form:
test.el:3:1:Warning: Argument load-path is not a lexical variable

This is for the following simple test case compiled by Emacs 24.3:

;;; -*- lexical-binding: t -*-

(defun my-test (load-path)
  (car load-path))
