I managed to reproduce this in 23.1 with
M-: (progn (rmail-cease-edit) rmail-buffer)
but I cannot reproduce it with the current trunk, so it looks like it
may have already been fixed.
Can you try the bzr trunk from
http://savannah.gnu.org/projects/emacs/
or the 23.2 pretest from
http://alpha.gnu.org/gnu/emacs/pretest/emacs-23.1.92.tar.gz
