Can it be more simple than this:
(unless inhibit-global-font-lock
(global-font-lock-mode t)
(customize-mark-as-set 'global-font-lock-mode))
provided that startup.el sets inhibit-global-font-lock
if -nfl or -no-font-lock is present,
or emacs-basic-display (-D) is true.
