Reproduced with:
rm -rf /tmp/foo
mkdir -p /tmp/foo
HOME=/tmp/foo emacs-24.3.93 -l package \
--eval "(progn (package-initialize) (package-refresh-contents) (package-install 'yasnippet))"
However I just get a byte-compilation warning, no error.
