This is clearly not intended behaviour, and the person should have reported a bug to the Gentoo bugtracker. I will suggest to him that he report it. I hope that Gentoo will also decide not to include ports for nonfree packages. Whether people use such programs is their responsibility, but whether we point them at such programs is our responsibility.
