This problem seems to be caused by the use of '#+header', so with
,------------------------

| #+header: :file out.txt
| #+begin_src sh
| echo blah
| #+end_src

I get the above error, but with
,-----------------------------

| #+begin_src sh :file out.txt
| echo blah
| #+end_src
`-----------------------------
I don't.
