No, it errors in the same way as it does without the patch.
Move: ‘/home/horn/tmp/foo’ to ‘/home/horn/tmp/foo/foo’ failed:
(file-error Renaming Invalid argument /home/horn/tmp/foo /home/horn/tmp/foo/foo)
