I was a bug in my ~/.bashrc, not in Emacs. I forgot that I originally had COLORTERM set there when TERM != linux, and that I changed the condition a week ago or so to TERM != fbterm. Sorry for the noise. So the conclusion is that TERM=linux implies 8 colors.
